TERMS OF SALES
Art 1: Object
The present general conditions of sale aim to define the rights and obligations of ET D'EMIE and of the customer of products presented by ET D'EMIE on its site. www.etdemie.com (hereinafter "the Site"). They apply exclusively between ET D'EMIE, SAS with a capital of €10,000 registered under the single number 851 249 060 RCS SAINT-NAZAIRE, whose head office is located at 134 hameau des Ajoncs 44740 Batz sur mer, France (hereinafter "ET D'EMIE") and any individual consumer visiting or making a purchase through said site (hereinafter "the customer").
On the site, ET D'EMIE allows the customer to order clothing and accessories online (hereinafter "the product(s)") according to these general conditions.
Any order placed with ET D'EMIE therefore entails the unreserved acceptance by the customer of these conditions.
These general conditions may be modified at any time and without notice by ET D'EMIE, the applicable conditions being those in force on the date of the order by the customer.
Art 2: Products and compliance
2.1. The products offered for sale are presented on the ET D'EMIE website and accompanied by a description
2.2. The products offered by ET D'EMIE comply with the standards applicable in France.
The customer has a description for each product containing the essential characteristics of the product concerned. These indications are updated automatically in real time. However, an error in the update, whatever its origin, does not engage the responsibility of ET D'EMIE.
Elements such as photographs, texts, graphics are not contractual. ET D'EMIE takes the greatest care in the presentation and description of the products to best satisfy the customer's information. However, it is possible that errors may appear on the site, which the customer acknowledges and accepts.
Art 3: Obligations of the customer
3.1. The customer declares to be at least 18 years old and to have the legal capacity or to hold parental authorization allowing him to place an order on the site.
3.2. The customer undertakes to communicate to ET D'EMIE the actual and necessary information for the performance of the service covered by these conditions as requested online and according to his situation, in particular his surname, first name, address. , telephone and valid e-mail.
The customer is responsible for the consequences arising from information transmitted that is false or inaccurate or whose recovery would be unlawful.
3.3. Once the order has been placed, ET D'EMIE sends the customer an e-mail confirming it. He informs him of the dispatch of the products.
3.4. The customer can modify his data under "my account".
Art 4: Price, availability and delivery
4.1. The prices displayed on the site are indicated in euros, all French taxes included (French VAT and other taxes that may be applicable), excluding shipping costs, participation in order processing costs and packaging costs. Shipping costs, participation in order processing costs and packaging costs will be indicated in the customer's basket, before the final validation of the order.
Prices are subject to change at any time, in particular due to promotions or sales or in view of price increases by manufacturers.
4.2. ET D'EMIE reserves the right to cancel or refuse an order in the event of a dispute with the customer on a previous order.
4.3. ET D'EMIE can accept orders within the limits of available stocks. It informs the customer of the availability of the products sold on the site at the time of the confirmation of the order.
If, despite the vigilance of ET D'EMIE, the products are unavailable, ET D'EMIE will inform the customer by e-mail as soon as possible.
The permanent or temporary unavailability can in no way engage the responsibility of ET D'EMIE, nor can it open any right to compensation or damages in favor of the customer.
In the event of temporary unavailability of a product, ET D'EMIE will inform the customer of the new deadlines applied by the suppliers and/or manufacturers of the product concerned. It reserves the right to offer the customer a replacement item of equivalent quality and price. In this case, the costs of returns resulting from the possible exercise of the right of withdrawal will be borne by ET D'EMIE. In the event that ET D'EMIE cannot provide the customer with an article of equivalent quality and price or if the latter does not wish this article of equivalent quality and price, the customer may cancel his order.
In the event of permanent unavailability, and if ET D'EMIE could not provide the customer with an article of equivalent quality and price, his order will be canceled automatically.
4.4. To buy one of the products, the customer can click on its graphic representation. This product is added to his shopping cart already containing, where applicable, other items that the customer wishes to purchase and previously placed in his shopping cart. The customer expressly declares that he has all the necessary authorizations for the purpose of using the payment method when validating his order. He also undertakes to ensure his solvency before any order, failing ET D'EMIE to be able to deliver the ordered products. In the event of insolvency, ET D'EMIE also reserves the right to suspend or cancel any order or delivery in the event of non-payment or cancellation of payment.
4.5. ET D'EMIE delivers its products in mainland France and around the world. The products are shipped with the delivery note, to the delivery address indicated by the customer when ordering. Delivery cannot be made to hotels or post office boxes.
4.5. Information relating to the delivery, such as the tracking number, carrier and delivery time are communicated once the order has been processed. In order for these deadlines to be respected, the customer must ensure that he has communicated exact and complete information concerning the delivery address (such as, in particular: street number, building, staircase, access code , names and/or intercom numbers, etc).
ET D'EMIE cannot be held responsible for the consequences due to a delay in delivery if ET D'EMIE provides proof that the non-performance or poor performance of the contract is attributable to the customer, either to the unforeseeable and insurmountable fact of a third party to the contract, or to a case of force majeure.
In the event of a damaged package (already opened, missing products, etc.), the customer agrees to notify ET D'EMIE, by any means, of any reservations within 3 days of receipt of the product.
Art 5: Payment
Payment must be made in one go.
Payment is secure. ET D'EMIE will never be in possession of the bank details of its customers. It can be done by credit card or Paypal.
Cards issued by banks domiciled outside France must be international bank cards. ET D'EMIE reserves the right to cancel any order when the customer's IP address is domiciled in a country different from the billing and/or delivery address.
In the event of payment by credit card, the amount of the order is debited at the time of the order on the site. The order is paid in one go. The simple fact of providing the bank card number entails authorization to debit the customer's account up to the amount of the order.
Art 6: Customs duties
Any order placed on the site and delivered outside of France may be subject to possible taxes and customs duties which are imposed when the package reaches its destination. These customs duties and any taxes related to the delivery of a product are the responsibility of the customer and are his responsibility. ET D'EMIE is not required to check and inform the customer of applicable customs duties and taxes. To find out about them, ET D’EMIE advises the customer to inquire with the competent authorities of his country.
Art 7: Returns, Exchange & Refund
The law maintains that the buyer of any product has a period of 14 days to withdraw and return the product if it does not suit him. The return costs are your responsibility, but we undertake to reimburse you for the product as soon as possible.
In the event of an exchange, the return costs are free if the place of delivery is in France. To claim a refund or exchange, however, the product must be in its original condition. It must not have been worn and washed.

In the event of non-compliance with these instructions, ET D'EMIE will not be able to make any refund.
Art 8: Retention of title
The products will remain the property of ET D'EMIE until full payment of the price by the customer.
In the absence of full payment made within a maximum period of 15 calendar days from delivery, the customer has the obligation to return, at his own expense, the aforementioned goods and the contract is deemed terminated from receipt by ET D'EMIE of the goods returned in good condition.
Art 9: Guarantees and liability
ET D'EMIE cannot be held liable for any inconvenience or damage inherent in the use of the Internet network, in particular a break in service, an external intrusion or the presence of a computer virus, or any event qualified as force majeure. , in accordance with the law and case law.
Art 10: Intellectual property
Under no circumstances is the customer authorized to download or modify all or part of the site and in particular its content (listed products, descriptions, images, videos, etc.)
This site or any part of this site must in no case be reproduced, copied, sold or exploited for commercial reasons without the express written authorization of ET D'EMIE.
In general, all copyrights, trademarks and other distinctive signs and property or intellectual property rights appearing on the site will remain the full property of ET D'EMIE.
The customer is therefore bound to respect intellectual property rights and may not in any way use the brands appearing on the site and on the products if necessary, or register a brand that would harm the holder of the rights, unless contractual provision to the contrary.
The same applies to any other intellectual property right.
When creating his customer account or an order, the customer must send ET D'EMIE his personal data (surname, first name, postal address, etc.). This data is used for the sole purpose of processing orders.
ET D'EMIE undertakes to use confidential customer information only in the context of the operation of its site. This data is in no way disseminated, shared or exchanged on any other platform.
The customer can modify his data at any time by withdrawing from the customer file AND EMIE.
